Virginia Tax Filing Guide

Here are detailed instructions for filing taxes in the state of Virginia.

Virginia Residents

If you made over $11,250 and lived in Virginia for more than 183 days of the year or are a legal resident of Virginia, you will need to file an tax return with Virginia. If you were a resident of Virginia for only part of the year but made all of your income from Virginia for the entire year use Form 760 and the provided instructions for filing Form 760 for additional help.

Virginia Residents who lived in Virginia for part of the year

You will need to file Form 760PY, for part year Virginia residents, if you moved into Virginia during the tax year and became either a domiciliary or actual resident (see Residents) or moved out of Virginia for more than 6 months as well as becoming a domiciliary resident of another state.

Please note: If you made income from Virginia while you were not a resident of Virginia you may still need to file Form 763 (see Nonresidents who had income from Virginia).

Virginia Residents who work in another state

If you are a Virginia resident you must file From 760. If you work in another state you must still report all income made to Virginia. Virginia does not allow for tax subtractions for income earned in other states rather such income will be addressed with Virginia tax credits.

Nonresidents who work in Virginia

If you are a nonresident of Virginia but made income from Virginia you will need to file Form 763 and use the included instructions to get more information. . Income from Virginia sources includes income from a job in Virginia, from the ownership of any property in Virginia or from any prizes won from the Virginia Lottery or any gambling locations in Virginia.

Income that doesn’t count as Virginia income, for taxing purposes, includes interest or dividends from personal savings accounts, individual stock market investments, or pension payments from a Virginia payer.

Kentucky and Washington D.C.

Residents of Kentucky and Washington D.C. who commuted to Virginia everyday, did not maintain a residence in Virginia for any time during the taxable year, and whose only income from Virginia sources was wages and salaries do not have to fill out Form 763. These nonresidents are subject however to Kentucky and Washington D.C.’s income taxes.

Maryland, Pennsylvania and West Virginia:

Residents of Maryland, Pennsylvania or West Virginia who were present in Virginia for less than 183 days of the tax year and whose only income from Virginia was wages and salaries do not have to fill out Form 763. These nonresidents are subject however to Maryland, Pennsylvania, or West Virginia’s income taxes.

Please note all exceptions for residents of Maryland, Pennsylvania, and West Virginia not having to file income using Form 763 is for income earned only through salaries and wages. For any other type of income you will still need to file Form 763.

Nonresidents who sold property in Virginia

If you are a nonresident of Virginia but made income from Virginia you will need to file Form 763 and use the included instructions to get more information on how to file. Income from Virginia sources includes income from the ownership of any property in Virginia or any prizes won from the Virginia Lottery or any gambling locations in Virginia.
