New York Residents

If you are a resident of New York state, and filed a Federal Tax Return, chances are you will need to file a New York resident return. To file a New York resident return use either Form IT-150 or Form IT-201. Both forms can be found below along with their instructions.

To determine if you need to file a Tax Return with the state of New York and if you need to use Form IT-250 or Form IT-201 use the 2009 Income Tax Form Selector tool on page 5 of the IT-201 Instructions.

Part-Year New York Residents

If you are a resident of New York for part of the year, you will be taxed on all income made during the time of you were a New York resident. You will also be taxed on all income from New York sources, regardless of your resident status. To confirm that you need to file a New York part-year resident return use the 2009 Income Tax Form Selector Tool. You will need to use Form IT-203 to file a New York part-year resident return. New York Residents who work in another state

If you are a resident of New York, but work in another state, you may need to file a tax return with both New York and the state you work in. If you need to file a tax return with New York, you will file as any other New York resident would (see the New York Resident section to figure out what form to use). To avoid dual taxation use New York Form IT-112-R to receive a tax credit for all taxes were paid to the state that you work in.
