Kansas Residents

If your domicile home was in Kansas for the entire year you are a Kansas resident. Kansas residents who were required to file a Federal tax return or earned more income that permitted (you must add the value in the Kansas Chart, attached below, to your deduction to find what amount is permitted) will need to file a Kansas resident income tax return. Please note that when filing your Kansas return your filing status will need to be the same status you filed for your Federal return, the only exception is that if you filed your Federal return as either a Qualifying Widow or Widower with Dependent Child your Kansas return status will be Head of Household. Part-Year Kansas Residents

If you moved into or out of Kansas during the last year, you are a part-year resident of Kansas. Part-year residents may file either as a Kansas resident or a Kansas nonresident. If you decide to file as a resident see the resident section (since the same filing requirements exist for part year residents). If you decide to file as a nonresident see the nonresident sections (since the same filing requirements exist for part year residents). You should examine both options for your own benefit.

Kansas Residents who work in another state

If your domicile home was in Kansas for the entire year, you are a Kansas resident. Kansas residents who were required to file a Federal tax return or who earned more income that permitted (you must add the value in the Kansas Chart to your deduction to find what is permitted) will need to file a Kansas resident income tax return. If you are a Kansas resident working in another state Kansas will tax the income you earned in the other state because all income earned by Kansas residents is taxed by Kansas. However you might be taxed on such income by the state the income was earned in. In this is the case, to avoid dual taxation on such income; Kansas offers a tax credit on this income. To file for this credit complete the worksheet in the Kansas Tax Booklet. You will need to file this worksheet along with your Kansas return (filed using Form-40), your W2 (obtained from your employer), and the other state’s return.

Non-Residents who work in Kansas

If you did not live in Kansas for any part of the year, you are a nonresident of Kansas. Kansas nonresidents who earned income from Kansas sources (see the Kansas chart to see what income is included) must file a Kansas nonresident return. There is no minimum-filing requirement so if you earned any Kansas sourced income you will need to file a Kansas nonresident return.
